FAQ - Frequently asked questions & answers - Temporary work Eastern Europe

Temporary work (also known as temporary employment, employee leasing or personnel leasing) means that the employee enters into an employment relationship with a personnel service provider, i.e. signs an employment contract with them for a permanent position. The personnel services company is the actual employer and is responsible for placing the employee in a job and assigning them to a client company or organisation. In most cases, the personnel requirements of the client company are temporary and the assignments can be short or long-term. It all depends on the industry, the field of activity and the customer you are working for. This allows companies to react quickly and flexibly to the constantly changing labour market. As an employee, you also have this flexibility and the opportunity to work in different companies.

When a supply of labour exists is defined in the §Section 1 (1) AÜG Act precisely regulated. Two requirements must be met for this:

  • A hiring company hires out labour to a third party, the hirer. These workers then perform work in the third company as part of their economic activity.
  • The employee is integrated into the work organisation of the hiring company. This means that the employee is now subject to the instructions of the hiring company.

In a Employment contract defines the conditions under which someone works. It defines the rights and obligations of both parties and is the basis for the employment relationship. The employment contract can take various forms, depending on the employment. 

Just like a regular employment contract, a temporary employment contract also regulates benefits such as health, pension, long-term care, accident and unemployment insurance.

The employment contract should focus in particular on special rights and obligations. The following points should also be checked carefully:

  • What are the details of the salary and working hours?
  • How long is the duration of the transfer, what are the regulations?
  • How are the holiday entitlement and period of notice formulated?
  • Are all the points discussed in writing?
