Temporary work allowed in the construction industry?

Due to the shortage of skilled workers in Germany, there is also a desire for flexible personnel assignments from abroad in the construction industry. However, very special rules apply to temporary workers in the construction industry, which must be observed. The assignment by a classic temporary employment agency in the main construction trade is prohibited according to § 1b AÜG.

Temporary employment is only permissible if it takes place exclusively between companies in the construction industry. And only within the following areas: construction, demolition, scaffolding, roofing and gardening and landscaping may be temporary workers. This means, for example, that only a construction company may provide personnel to a construction company.

Apart from the fact that hiring out in the construction industry is only legally permissible under very narrow conditions, since both the hirer and the borrower must be companies in the same construction industry.

Subcontractors in construction are a good alternative to temporary workers in construction. In Germany, many subcontractors are used in the construction industry. This offers construction companies many advantages and increased flexibility.
